Terms of Service

1. Acceptance of Terms

By creating an account or using QwickOps ("Service"), operated by Qwick Services and Solutions LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

QwickOps is a cloud-based service management platform designed for commercial kitchen service companies. The Service includes job management, scheduling, compliance tracking, invoicing, and related business tools.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must be at least 18 years old to use the Service.

4. Free Trial

We offer a 30-day free trial with full access to your selected plan's features. At the end of the trial, your account will automatically transition to the Free plan unless you subscribe. No credit card is required for the trial.

5. Subscriptions and Billing

Paid subscriptions are billed monthly or annually based on your selected billing cycle. Prices are as listed on our pricing page at the time of purchase. We reserve the right to change pricing with 30 days' notice. You may cancel at any time; cancellation takes effect at the end of the current billing period.

6. Plan Limits

Each plan includes specific limits on users, jobs, customers, locations, and storage. If you exceed your plan's limits, you may need to upgrade to continue using certain features. We will not delete your data if you exceed limits.

7. Data Ownership

You retain full ownership of all data you submit to QwickOps. We do not sell, share, or monetize your data. We access your data only to provide and improve the Service, and as described in our Privacy Policy.

8. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to other accounts or systems; (c) interfere with or disrupt the Service; (d) upload malicious code or content; (e) resell the Service without authorization.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control.

10. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, you may request an export of your data within 30 days. After 30 days, data may be permanently deleted.

11. Limitation of Liability

To the maximum extent permitted by law, QwickOps and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
